Bankruptcy Law: Fortunate relief for the Debtors
Bankruptcy law is a legal procedure that provides possible relief to the individuals or organizations that are unable to re-pay their loan amount due to financial hardship. However, this law does not authorize the respective individuals to entirely escape from the liability of their debts; rather their terms and conditions are modified. According to the new terms and conditions, the debtors need to re-pay lesser amount as approved by the court.
The new terms and conditions redefined by bankruptcy law depend upon the condition of the debtors because the purpose is to protect the interests of debtor as well as the lender. In the country, this law has become common and has been well accepted by the debtors as well as lenders. Any debtor, who faces financial problem, can directly approach the court under the bankruptcy law.
In addition, this law also facilitates organizations, firms, and local governments to get their terms and conditions modified during their financial crisis. Likewise, the bankruptcy law gives a fresh start to debtors so that they can re-pay their loan in a more convenient way. The objective is to prevent the debtors from becoming destitute and to protect organizations from becoming extinct.
However, the aim of this law is not only to protect the debtors but also to take care of the interests of lenders or creditors. It ensures that the creditors are repaid. For this, bankruptcy courts either Liquidates or sells the property of the debtor or restructures the debtor’s finances. Once this law has been implemented and debtor complies with the court’s order then the creditor has no right to take any action against the debtor to collect the money.
This is the reason that some people prefer to call bankruptcy law as ‘bankruptcy relief’ or ‘bankruptcy protection.’ But one of the negative aspects of this law is – if debtor files a case for bankruptcy then possibly, he will not get credit for the next seven years.
In spite of some demerits, bankruptcy law is a great savior for the debtors.
